By downloading, installing, or using Pently ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Pently is a mobile application that helps you manage shopping lists and pantry inventory. The App provides tools to:

• Create and manage shopping lists
• Track product inventory
• Store product information, photos, and notes
• View store specials and pricing information

3. Use of the App

Permitted Use

You may use Pently for personal, non-commercial purposes in accordance with these Terms.

Prohibited Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App to transmit any harmful code or malicious software
• Interfere with or disrupt the App's functionality

4. User Content and Data

All data you create within the App (shopping lists, product information, photos, notes) is stored locally on your device. You retain ownership of all your data.

Your Responsibilities

• You are responsible for maintaining backups of your data
• You are responsible for the accuracy of information you enter
• The App is not a backup service; data loss may occur if you uninstall the App or clear app data

Our Access to Your Data

We do not access, collect, or transmit your data. All data remains on your device.

5. Intellectual Property Rights

The App, including its design, code, graphics, logos, and content, is the property of the App developers and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes only.

6. Store Specials and Third-Party Information

The App may display store specials, pricing, and product information from third-party sources. This information is:

• Provided for informational purposes only
• Subject to change without notice
• Not guaranteed to be accurate or current
• Not endorsed by us

You agree to verify any pricing or product information before making purchasing decisions.

Information Accuracy

We do not guarantee the accuracy, completeness, or timeliness of any information displayed in the App, including store specials and pricing.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY OR PROPERTY DAMAGE
• ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including violation of these Terms.

You may stop using the App at any time by uninstalling it from your device.

We reserve the right to:

• Modify, update, or discontinue the App at any time
• Update these Terms from time to time

We will notify you of material changes to these Terms by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. If you are using the App from outside South Africa, you agree to comply with local laws applicable to your jurisdiction.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through the courts of South Africa. If you are using the App from outside South Africa, you may also have rights under your local consumer protection laws.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
